How to determine your scenario by four criteria?

Four criteria determine your scenario: your current basis of stay, Karta Polaka or Polish descent, marriage to a Polish citizen and the continuity of your UKR status. The first criterion is when you came to Poland and on what basis you are currently staying. If after 2022 you have UKR status, held a PESEL UKR as of 04.06.2025 and have kept the status continuously for at least 365 days, your path is scenario A. No PESEL under UKR, but you have a job, then this is scenario B: transition to pobyt czasowy. You already have a temporary residence card and work? That is scenario F.

The second criterion is Karta Polaka or Polish descent. They override all other conditions. If you have a KP in hand, your scenario is C: stały pobyt immediately, without a minimum period of stay in Poland. If you have Polish roots but no card, this is scenario E: you can apply for stały pobyt straight away by documenting your descent, or obtain a KP first.

The third criterion is marriage to a Polish citizen. Here scenario D applies: on the day you apply, the marriage has lasted at least 3 years and you have lived in Poland continuously for at least 2 years on a card issued in connection with that marriage.

The fourth criterion is the continuity of UKR status. A break in it breaks the calculation of periods for scenario A.

Applications for CUKR under scenario A close on 04.03.2027, although the UKR status itself is valid until 04.03.2028. If your criteria do not match any row, the question requires separate clarification, because the combination is atypical.

Scenario A: CUKR for those who have UKR status and PESEL

This scenario is suitable if you came after 2022, have UKR status, held a PESEL UKR as of 04.06.2025, and have had UKR status continuously for at least 365 days, including on the day you apply. The CUKR card is not a separate privilege, but an intermediate link in a long chain.

The chain looks like this:

  1. UKR status (until 04.03.2028)
  2. CUKR · 3 years
  3. Pobyt czasowy (work/business) · ~2 years
  4. Rezydent długoterminowy UE [B1 + stable income]
  5. Uznanie za obywatela polskiego

Approximately this is about 8 years from the day you receive the CUKR card. Time spent under UKR status does not count towards this period at all, so you cannot count from your arrival date. The exact date depends on when you submit the application and when you receive the card.

Deadlines that do not shift. Applications for CUKR are accepted until 04.03.2027. The UKR status itself, after the extension of protection, is valid until 04.03.2028, so the dates have diverged: submission closes a year earlier. If this deadline is missed, the UKR status will simply end, and the transition to a temporary permit will have to be made from a different starting position.

What disappears along with UKR. Obtaining CUKR terminates the UKR status and, along with it, special access to NFZ under Art. 37 Specustawy. After that, health insurance goes only through ZUS and employment, through a sole proprietorship, or as voluntary, approximately 620 zł per month. Free accommodation and meals in collective accommodation centers also close. The 800+ payment is not lost in this case: it remains, but on general grounds, not as part of the UKR package.

While UKR is still in effect, you can open a JDG on equal rights with citizens: only a PESEL is needed. This should be used before the transition, because under CUKR the conditions for business are already different.

Next step: submit an application for CUKR via mos.cudzoziemcy.gov.pl by 04.03.2027. Through MOS, from 27.04.2026, applications are accepted for zezwolenie na pobyt czasowy, pobyt stały, and pobyt rezydenta długoterminowego UE, and CUKR is included in this list.

Scenario B: pobyt czasowy, if there is no PESEL UKR

This path suits you when there is no UKR status or related PESEL, but you have a job or your own business. It does not depend on your current basis of stay in Poland. Only two conditions matter: employment or your own business, and a stable income sufficient to support yourself and your dependents.

The logic is as follows: you enter legal pobyt czasowy, and then you build up continuous tenure. The first permit is a zezwolenie na pobyt czasowy, which is issued for a specific purpose: work (Art. 114 ust. 1) or running a business. The permit must not be interrupted: it is continuity that determines when the next stage opens.

Next comes Rezydent długoterminowy UE. It will require five years of continuous legal residence on temporary permits, Polish language at B1 level, and stable income. The tenure is counted from the date of the first permit, not from the date of entry, so it is worth applying not "by eye" but after calculating the specific day.

The final step: uznanie za obywatela polskiego. After the EU resident status, the law requires another three years of residence on this status.

In total, the approximate timeframe is ~8 years from the start of the first pobyt czasowy: 5 years to EU long-term residence and 3 more to citizenship. This is one of the longest scenarios, and that is precisely why it makes sense only when faster grounds (Karta Polaka, marriage, Polish origin) are unavailable.

Separately about the transition. If you are currently on UKR status and apply for pobyt czasowy, this automatically terminates UKR and the related payments. The decision is irreversible, so first make sure that the employer is truly ready for the procedure and that the income is confirmed by documents.

Scenario C: Karta Polaka, the shortest path to citizenship

If you have Polish roots, this option should be checked first: it gives the fastest result among all scenarios.

Entry condition: you already hold a Karta Polaka. If you have no card but can document Polish descent, see scenario E: it leads to the same stały pobyt without a KP.

What the card gives. The holder of a Karta Polaka applies for stały pobyt immediately, without any minimum period of prior residence in Poland. This is the main difference from the other paths, where you first have to work for years on a temporary permit. The legal basis is Art. 195 ust. 1 pkt 9 ustawy o cudzoziemcach.

Then to citizenship. 1 year on stały pobyt and confirmed Polish language at B1 level is sufficient. The norm is Art. 30 ust. 1 pkt 7 ustawy o obywatelstwie polskim: it covers in one sentence both Polish origin and the Karta Polaka. The same point, by the way, applies not only to cardholders.

In total, approximately 1 year plus the processing time of two applications (for stały pobyt and for uznanie). This is the shortest route to Polish citizenship among all those described in this material.

Where to apply. Abroad, applications go to a Polish consul (in Ukraine, Moldova and other countries). If you are already legally staying in Poland, they go to the voivode. The MOS portal does not apply to the Karta Polaka: via mos.cudzoziemcy.gov.pl, from 27.04.2026, only applications for zezwolenie na pobyt czasowy, pobyt stały and pobyt rezydenta długoterminowego UE are accepted. Karta Polaka is not on this list.

What to do next. If you already have the card and you have legal status in Poland, apply for stały pobyt via MOS. If you do not have the card, go to scenario E.

The card itself is valid for 10 years and is renewable. The right to work without a permit and without an oświadczenie o powierzeniu pracy is retained by the holder of a valid card (Art. 3 ust. 5 pkt 1 ustawy z 20.03.2025, in force from 01.06.2025), provided there is legal stay or visa-free status.

Scenarios D, E and F: marriage, Polish origin without KP, existing pobyt czasowy

Scenario D: marriage to a Pole. There are two stages. First, stały pobyt (Art. 195 ust. 1 pkt 4 ustawy o cudzoziemcach): on the day you apply, the marriage has lasted at least 3 years and you have lived in Poland continuously for at least 2 years on a card issued in connection with that marriage. No other card counts towards those two years. Then uznanie za obywatela polskiego under Art. 30 ust. 1 pkt 2 lit. a: another 2 years on stały pobyt, a marriage of at least 3 years and Polish at B1 level. If you get the marriage-based card right away, this comes to roughly 5 years from the start of the marriage. The stały pobyt application is filed via MOS.

Scenario E: you have roots, but no Karta Polaka yet. The card is not required here: a person of Polish descent can apply for stały pobyt straight away (Art. 195 ust. 1 pkt 3 ustawy o cudzoziemcach) if they document their descent and intend to settle in Poland permanently. The other option is to obtain a KP first from a Polish consul (abroad) or the voivode (if you are already legally in Poland). The MOS portal does not apply to the Karta Polaka: since 27.04.2026 MOS accepts only applications for pobyt czasowy, pobyt stały and rezydent długoterminowy UE. From there the route is the same as in scenario C: 1 year on stały pobyt plus B1 and uznanie under Art. 30 ust. 1 pkt 7, which covers both descent and the KP. Roughly 1 year plus processing time, and if you get a KP first, add that too.

Scenario F: you already have pobyt czasowy. You change nothing: you extend the permit continuously, counting 5 years from the date of the first permit. After that comes Rezydent długoterminowy UE, which requires B1 and stable income, and then 3 years to uznanie. The key is not to break continuity and to calculate the date of application for the rezydent in advance.

What changes after a status change and which steps to take first

The transition between statuses is almost never "neutral": along with the new card, the set of rights changes. This is most noticeable for UKR holders who receive CUKR. The card terminates the UKR status and, with it, special access to NFZ under Art. 37 Specustawy. After that, health insurance goes either through work and ZUS, or through a sole proprietorship, or as voluntary, approximately 620 zł per month. Free accommodation and meals in collective accommodation centres also disappear.

Benefits are a separate story, and here a common mistake occurs. 800+ after switching to CUKR is not lost: UdSC states in its own FAQ that the person remains entitled to benefits under other provisions if they meet their conditions. The basis changes from Art. 1 ust. 2 pkt 2 lit. ca to lit. d ustawy o pomocy państwa w wychowywaniu dzieci, but the requirement of professional activity in the previous month is the same in both cases. That is, the transition itself does not zero out the benefit: what is lost is the UKR package itself, not social rights as such (official UdSC explanation on CUKR).

An obligation is added that many do not expect: you must notify the voivode of a change of place of stay within 15 working days. This applies to CUKR card holders.

The steps for submitting depend on what exactly you are applying for. Applications for zezwolenie na pobyt czasowy, pobyt stały and pobyt rezydenta długoterminowego UE from 27.04.2026 are accepted by the MOS portal: possibilities of legalizing stay at mos.cudzoziemcy.gov.pl. Karta Polaka is not part of MOS: it is processed at a Polish consulate abroad or at the voivode if you are already legally staying in Poland.

The first thing to do before changing status is to calculate what exactly you are losing and how it is covered. For CUKR it is insurance. For switching from UKR to pobyt czasowy, the same plus the termination of UKR social benefits.

Does UKR status count toward the 5 years for Rezydent UE?

No. UdSC explicitly states that the period of stay in Poland on the basis of UKR status is not counted toward the five-year period, and the count begins only from the day of receiving the CUKR card. Until what date can an application for CUKR be submitted?

The submission deadline is 04.03.2027. It does not coincide with the end of UKR status: the protection itself is extended until 04.03.2028, but applications are accepted a year earlier.
